Just when you thought that the Trump administration couldn’t be any more heartless and cruel to the immigrant population, they think up an even more evil way to say “Hold my beer.” In a new regulation being drafted by the Trump Administration, a legal immigrant can be labeled as a possible drain on society, and have their application or renewal for visas and legal residences denied for utilizing assistance programs including an Obamacare subsidy.
Under our current laws, only cash assistance programs such as Temporary Aid to Needy Families can be used against an applicant in immigration determinations. However, newly proposed regulations would change that in a big way. In addition to cash assistance being a determining factor in considering an immigrant a “public charge” of the US, an Obamacare subsidy and the following programs have been included in that consideration:
- Head Start
- Children’s Health Insurance Program (CHIP)
- Food Stamps
- Section 8 or subsidized housing
- Low Income Energy Assistance Program
To add to the insult, not only is the applicant targeted, but any program utilized by their US-born children labels them as a “public charge” too. Conceivably if a legal immigrant signs their citizen child up for Head Start, they can lose legal status and be deported under this proposed regulation.
There is an out to being labeled a possible “Public Charge” under this proposal. You can pay a $10K fee to remove the “public charge” label. However, if you need any assistance in the future you can still lose your legal status, be deported, and the fee is not refunded.
This proposed regulation is draconian and un-American. Who can predict the future and say they will never need assistance? Even natural-born US citizens get laid off, fall on hard times, and need a hand up from time to time. Expecting our LEGAL immigrant population to never need any sort of help is laying the foundation for them to fail. Their US-born children could face poverty, food insecurity, and a lack of healthcare to maintain the legal status of the parent. It is just another soulless attack on all immigrants.
